THIS AGREEMENT DESCRIBES THE TERMS AND CONDITIONS UNDER WHICH YOU CAN SEND AN INSTANT PAYMENT FROM YOUR ELIGIBLE CHECKING OR SAVINGS ACCOUNT USING CITIBANK®ONLINE OR CITI MOBILE® TO AN INDIVIDUAL OR BUSINESS WITH AN ACCOUNT AT ANOTHER FINANCIAL INSTITUTION PARTICIPATING IN THE REAL-TIME PAYMENT NETWORK. THESE TERMS AND CONDITIONS DO NOT APPLY TO TRANSFERS MADE VIA THE ZELLE NETWORK, CITIBANK GLOBAL TRANSFERS, INTER INSTITUTION TRANSFERS, OR TRANSFERS MADE THROUGH OUR WIRE SERVICE, ALL OF WHICH ARE SUBJECT TO SEPARATE AGREEMENTS.
BY CLICKING THE "ACCEPT" BUTTON BELOW, YOU CONSENT TO RECEIVE, IN ELECTRONIC FORM ON CITIBANK® ONLINE, THESE TERMS AND CONDITIONS AND CERTAIN RELATED TRANSACTION DISCLOSURES AND PROVIDE YOUR AGREEMENT TO THESE TERMS AND CONDITIONS.
You and other authorized account signers (hereinafter "You") can use the Instant Payment Service ("Service") to receive a Request for Payment (hereinafter "RFP") from other individuals or businesses ("hereinafter Person") with a bank account at a financial institution participating in the Real-Time Payment Network (the "Network") and to pay a RFP by instructing Citibank, N.A. (hereinafter "Citibank", "our", "us", "we") to make an electronic transfer of funds from an eligible checking or savings account to that Person using the Network. (Note: At a future date, you will also have the ability to send an RFP to another Person to request that a payment be sent to your eligible checking or savings account. We will notify you when this service is introduced.)
You can also use the Service to initiate a payment/transfer to a recipient (either you or a third party) with a bank account at another financial institution participating in the Network. This feature allows you to send a payment/transfer without having received a RFP after you add your recipient as a new payee and the Network verifies that your payee is eligible to receive an Instant Payment ("Eligible Payee").
The Service is available for funds transfers between accounts in the United States only in U.S. dollars. In order to enroll in the Service, you must have an open and active Citibank checking or savings account. We may require you to validate certain account information before you are permitted to use the Service to send a payment either in response to a RFP or alternatively as a separate payment you initiate.
When you receive a RFP, any information about that RFP, including the name of the Person sending that request along with the name of that Person's financial institution, will be visible via Citi® Online to authorized account signers on your eligible checking or savings account. Those account signers will also have the ability via Citi® Online to enroll in the Service and to either send a payment in an amount they designate in response to that RFP or alternatively, to disregard the RFP. Additionally, those account signers will be able to separately initiate a payment/transfer to an Eligible Payee you have added as a payee eligible for the Instant Payments service.
Upon your receipt of an RFP, you may request through Citi® Online or Citi Mobile® that Citibank send an Instant Payment in an amount you designate to the Person submitting that RFP or, alternatively, you can elect to disregard the RFP. These Instant Payments are subject to the outgoing transfer limits for "RFP" transfers described in the chart in Paragraph 7 below.
You may also send an Instant Payment (without having received a RFP) in an amount you designate to an Eligible Payee that you have previously set up to receive Instant Payments. These Instant Payments are subject to the outgoing transfer limits for "Send" Transfers described in the chart in Paragraph 7 below.
By making a request to Citibank to send a payment, you authorize us to debit your account for the amount of the payment and to transfer that amount to the Person or Eligible Payee designated. You understand that transfers made via the Service are irrevocable and cannot be reversed or stopped once made. You also understand that your account will be debited immediately for the amount of the payment and a transfer will be made in real time to that Person's/Eligible Payee's financial institution. The funds are made immediately available to the Person/Eligible Payee receiving your payment.
You are permitted to make a one-time immediate or future-dated payment either in response to an RFP or alternatively, as a separate payment request you initiate . Recurring payments are not available in connection with this Service at this time. The Service is available 24 hours a day, 7 days a week, including weekends and holidays. However, the Service may not be available from time to time due to scheduled or unscheduled maintenance.
You agree that you will not use the Service for any payment that would violate any federal, state or local law or regulation.
Your payment may be delayed or not executed if:
In situations when Citibank is unable to execute your payment instruction for reasons described above, you will receive an online status message indicating "failed" at the time you provide the instruction. Should your payment instruction be subject to further review for compliance, regulatory, or fraud purposes, you will receive an online status message indicating "on hold" at the time you provide the instruction. In certain cases, you may also receive a separate notice regarding the status of your payment instruction if additional information is needed to process your payment. In any event, once your payment instruction has been reviewed, you will receive a separate confirmation that the transaction has either been processed or alternatively, that the transaction could not be processed. If we send notice by email, we will use the email address of the primary signer/owner on your account. We have no control over the actions of financial institutions receiving your payment(s) that could delay or prevent delivery of your payment to your intended Person.
Since all payments are irrevocable and cannot be reversed, you should use the utmost care to verify that the RFP you receive relates to a payment to a Person/Eligible Payee you know and that the amount you enter is correct before sending a payment. We make no representations or warranties that the information contained in an RFP is accurate and complete. It is your responsibility to verify the accuracy of that information prior to sending a payment. You will still be responsible for any payment you authorize us to make even if you enter the wrong amount. We shall not be liable for any typographical, keystroke or other errors made by you when using the Service. You are responsible for resolving any payment or other disputes you may have with the Person to whom you send a payment through the Service.

Your rights and obligations in the event of an unauthorized transfer from your account in connection with the Service are described in the Electronic Banking terms in your Citibank Client Manual-Consumer Accounts or Consumer Deposit Agreement (for personal accounts) in subsection "Errors and Problem Resolution Procedures" or CitiBusiness® Client Manual (for business accounts) in subsections "Errors and Problem Resolution Procedures" and "Unauthorized Transactions".
We may modify or discontinue the Service, without prior notice except as required by applicable law, without any liability to you.
We reserve the right to terminate your use of the Service at any time if we suspect that you have violated any of these terms or conditions or are otherwise using the Service in a fraudulent or other illegal manner.
You acknowledge and agree that from time to time your use of the Service may be delayed, interrupted, or disrupted for an unknown period of time for reasons we cannot control. Neither we nor our affiliates will be liable for any claim resulting from or related to the Service due to such delay, interruption, disruption or similar failure. We have no obligation to correct any bugs, defects or errors in the Service to otherwise support, maintain, improve, modify, upgrade, update or enhance the Service.
EXCEPT AS OTHERWISE PROVIDED HEREIN, AND SUBJECT TO APPLICABLE LAW, NEITHER CITIBANK NOR THE REAL-TIME PAYMENT NETWORK MAKES ANY EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER WITH RESPECT TO THE SERVICES. CITIBANK AND THE REAL-TIME PAYMENT NETWORK EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, WITH REGARD TO THE SERVICE DESCRIBED OR PROVIDED. NEITHER CITIBANK NOR THE REAL-TIME PAYMENT NETWORK WARRANTS THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
EXCEPT AS OTHERWISE PROVIDED HEREIN AND SUBJECT TO APPLICABLE LAW, IN NO EVENT WILL CITIBANK OR THE REAL-TIME PAYMENT NETWORK AND THEIR RESPECTIVE OWNERS, DIRECTORS, OFFICERS, AGENTS OR NETWORK BANKS BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER INDIRECT DAMAGES ARISING OUT OF (I) ANY TRANSACTION CONDUCTED THROUGH OR FACILITATED BY THE SERVICE; (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER (INACCURACIES IN THE PRODUCTS OR SERVICES DESCRIBED OR PROVIDED, (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, OR (IV) ANY OTHER MATTER RELATING TO THE PRODUCTS OR SERVICES DESCRIBED OR PROVIDED, EVEN IF CITIBANK OR THE REAL-TIME PAYMENT NETWORK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE SERVICE OR WITH THE TERMS OF THESE TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICE.
IN THOSE STATES WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES MAY NOT APPLY, ANY LIABILITY OF CITIBANK OR THE REAL-TIME PAYMENT NETWORK, THEIR RESPECTIVE OWNERS, DIRECTORS, OFFICERS AND AGENTS OR THE NETWORK BANKS LIABILITY IN THOSE STATES IS LIMITED AND WARRANTIES ARE EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW, BUT SHALL, IN NO EVENT, EXCEED ONE HUNDRED DOLLARS ($100.00).
You acknowledge and agree that you are personally responsible for your conduct while using the Service, and except as otherwise provided in these Terms and Conditions, you agree to indemnify, defend and hold harmless us and the Network, and our respective owners, directors, officers, agents, and Network Banks from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorney's fees resulting from or arising out of your use, misuse, errors, or inability to use the Service, or any violation of these Terms and Conditions.
The same laws that govern your enrolled Account shall govern these Terms and Conditions.
We reserve the right to change these Terms and Conditions without prior notice unless otherwise required by law. You can access the current version of these Terms and Conditions on Citi Online, and you should review them on a regular basis.
Citibank does not charge fees for using the Service. But ordinary account fees may apply.
You understand and agree that, to the extent authorized in the section of your Client Manual-Consumer Accounts, Consumer Deposit Agreement or CitiBusiness Client Manual describing arbitration terms, we may require any dispute arising from the Service or an individual transfer to be resolved by binding arbitration.

In order to use the Service and to view and retain a copy of these Terms and Conditions and certain related transaction disclosures, you understand that you must have: 1) either (a) a personal computer equipped with a web browser with at least 128-bit encryption or 2) an Internet connection; and 3) (a) systems capability on your personal computer or on your mobile device to view and save or print files in pdf format using Adobe Acrobat Reader or other similar software; or (b) the ability to email or print using functions available. You understand that you can also obtain a printed copy of these Terms and Conditions by calling 1-800-374-9700 (TTY: 1-877-693-0372).
In order to enroll and use the Service, You consent to receive and accept the terms and conditions of these Terms and Conditions, and any amendments to them, and certain transaction disclosures electronically. You agree that Citibank reserves the right to provide information, notices and disclosures about the Service to You by non-electronic means. You may withdraw your consent to having records of transfers provided electronically by contacting us at 1-800-374-9700 for consumer (TTY: 1-877-693-0372) or 1-888-248-4287 for small business; however, by doing so You understand that Citibank may terminate your right to use the Service.
By clicking on the "Accept" button, You agree that: (1) You will be bound by these Terms and Conditions; (2) You have hardware and software that satisfies the above requirements; (3) You will receive information about the Service electronically, including these Terms and Conditions and any subsequent amendments to them.
